What an employer can do under Domestic worker law UAE?

In December 2022, Federal Decree-Law No. 9 of 2022 will replace Federal Law No. 10 of 2017 on Domestic workers. The revised domestic worker law UAE has given employers and employees explicit instructions on behaving during employment tenure.

  1. Provide domestic workers with all of the resources they need to complete their jobs efficiently.
  2. Provide appropriate housing for domestic workers.
  3. If the domestic worker is recruited full-time, the employer is responsible for providing meals and clothing. If the domestic worker works part-time, it depends on their agreement; otherwise, it does not require.
  4. According to UAE domestic worker law, the employer requires to pay the employee’s salary on time or face legal consequences.
  5. The employer should provide proper health care insurance for the domestic worker or bear all medical expenses if the worker becomes ill.

  12. The employer cannot charge the domestic worker directly or indirectly in the name of recruiting or punishment.  If the employer wishes to deduct from the employer’s remuneration should be taken approval from the ministry.
  13. If a domestic worker violates the contract, the employer must contact the ministry, and the employer has no choice but to follow the ministry’s decision.
  14. The employer bears the cost of the domestic worker’s repatriation to his or her home country.
  15. The employer must adhere strictly to government decrees regarding domestic employees in the UAE.

What is domestic worker contract dubai?

A domestic worker contract in Dubai is a legal agreement between an employer and a domestic worker that governs the rights and obligations of both parties.

Once the employee accepts the job offer from the employer, both parties sign the contract. Nobody can work in the UAE without a work permit, so the employer applies for a work permit on behalf of each employee to the ministry of labor.

The jointly signed contract document must be submitted with the work permit application to obtain it from the ministry of labor.

The employer should sign the two contracts with the recruitment agency and the domestic worker.

  1. Employer and recruitment agency:

Recruitment agencies and employers shall enter into a Contract, defining their respective responsibilities relating to the recruitment of domestic workers, in particular, this contract shall include the following:

  • The recruitment agency recruits domestic workers as per the employer’s requirement.
  • Employers must respect domestic workers’ rights and privileges, especially regarding the nature of work and salary.
  • Time required for the completion of the recruitment process
  • If either party fails to comply with the contract, the compensation will be as specified.

2. Employer and domestic worker: 

To apply for a labor card and a residency visa, both the employer and the domestic worker must sign a contract.

Although the contract can be written in English or Arabic, it should be translated into the employee’s mother language. The goal is for the employee to understand what document he or she is signing.

The contract should clearly state the following;

  1. The date of the agreement,
  2. Date of Joining,
  3. Nature and place of work,
  4. duration of the agreement,
  5. the total amount of remuneration,
  6. payment method,
  7. authorized leave,
  8. probation period,
  9. rest periods,
  10. Result in the termination of the contract

The following are critical points that every domestic worker should be aware of:

  1. Contract Validity;

The contract is valid for two years and can renew after that. If both parties (employer and employee) agree on contract termination they can do so before two years.

2. Probation period;

The employer can set a probation period of not more than 6 months. If the contract terminates result of the employee’s behavior during the probationary time employer does not require to pay the compensation.

3. weekly holiday;

Domestic employees are entitled to weekly paid leave after working for 6 days. If an employee works on an off day, he or she should take an alternate day off or pay cash as overtime.

4. The working hours;

The everyday domestic worker is entitled to rest for 12 hours. The 8 hours are consecutive working hours and any additional hours of work should not exceed 4 hours in a day.

5. Annual Leave;

Domestic workers are entitled to 30 days of vacation each year, and employers must offer a basic salary and two round-trip tickets to the employer’s home country.

6. Sick leave;

Every year domestic worker gets 30 days of sick leave which calculates as follows;

    • The first fifteen days are paid in full.
    • The next thirty days at half pay.

7. Other Compensations;

After contract termination, the employer must pay cash in lieu of unused annual leaves and holidays. The calculation will depend on the employer’s current basic salary.

Gratuities or end-of-service benefits are stipulated in UAE labor law for other sectors, but for domestic workers, it depends on the contract between the employer and the domestic worker.
